Heard Sri Ravendra Singh, learned counsel for the appellant and learned A.G.A. for the State. 2. The present appeal has been filed against the judgement and order dated 28.07.2022 passed by learned Sessions Judge, Baghpat in S.T. No. 91/2005, State Vs. Kanwar Gaitha and others arising out of Case Crime No. 100- A/2004 u/s 148, 307/149 I.P.C., Police Station- Chandi Nagar, District- Baghpat, by which the appellant has been convicted and sentenced to undergo 3 years rigorous imprisonment and fine of Rs.5,000/- u/s 148 I.P.C. and 10 years rigorous imprisonment and fine of Rs.10,000/- u/s 307/149 I.P.C. along with default stipulation. 3. Learned counsel for the appellant has submitted that by the impugned conviction order, appellant was awarded 10 years maximum sentence and the appellant has already completed 10 years of incarceration. He does not wish to pursue this appeal and prays that he may be permitted to withdraw the case. 4. In view of the above request, the present appeal is dismissed as withdrawn.
