3. The applicant – Monu Pal, who is in judicial custody in connection with FIR/ Case Crime No. 256 of 2025, under Sections 115(2) of BNS and Section 5(d)(k)/ 6 of POCSO Act, registered at P.S.- Patelnagar, District Dehradun, has sought his release on bail.
4. Heard learned counsel for the parties and perused the records.

In this case, FIR was lodged on 30.05.2025 by the mother of the victim alleging therein that the complainant got her two children admitted in the boarding school in the month of April, 2025 and when she went to meet her children then they told her that the applicant beats them with iron stick and puts burning cigarette’s butts in their body.

Learned counsel for the applicant would submit that the applicant was arrested on 31.05.2025 and is languishing in jail since then. Learned counsel for the applicant has further drawn the attention of the Court to the statement of the doctor, in which it is recorded that only small sized abrasions marks simple in nature could be seen in the body. As such, statements of the doctor does not corroborate with the facts of the case.
7. Learned State Counsel, on the other hand, has vehemently opposed the bail application.
8. Having considered the
submissions, under the facts and circumstances of the case, the fact that the statement of the doctor does not corroborate with the facts of the case, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.
9. Accordingly, the bail application is allowed.
10. Let the applicant be released on bail on his executing a personal bond and furnishing two reliable sureties each of the like amount, to the satisfaction of the court concerned.
11. Let a certified copy of this order be supplied to learned counsel for the parties today itself, as per rules.
