IN THE HIGH COURT OF HIMACHAL PRADESH AT SHIMLA CMPMO No.430 of 2018 Decided on 06th November 2025 Shri Raj Pal another …Petitioners Versus Smt. Saroj Sharma …Respondent Coram Hon’ble Mr. Justice Ajay Mohan Goel, Judge 1Whether approved for reporting? For the petitioners : Mr. Sanjeev Sood, Advocate. For the respondent : Mr. Neeraj Gupta, Senior Advocate, with Ms. Rinki Kashmiri, Advocate. Ajay Mohan Goel, Judge (Oral) By way of this petition, the petitioners have assailed the order passed by the learned Court, in terms whereof, in an application filed under Order 39 Rule 1 and 2 of the Civil Procedure Code alongwith the suit by the plaintiff order of status quo was passed by the learned Trail Court as well as the judgment passed by the learned Appellate Court, in terms whereof, the appeal filed by the present petitioners against the order passed by the Trial Court was dismissed. 2 2. This petition under Article 227 of the Constitution of India was filed in the year 2018 and perusal of the record demonstrates that no interim was granted by the Court in these proceedings. 3. In the light of the fact that the status quo order is enforced since the year 2017, obviously, these proceedings have lost their efficacy and the same are, therefore, closed with the observation that Trial Court shall make an endeavor to decide the Civil Suit as expeditiously as possible. Pending miscellaneous applications, if any, also stand disposed of. (Ajay Mohan Goel) Judge November 03, 2025 (Vinod)
