1. The petitioner is a widow of Late Shri Sukhdev Kewat who was working on the post of Chowkidar Class-IV employee in the respondent Department/ CSIDC and died on 15/01/2013 during his service tenure.
2. By the present writ petition, the petitioner is questioning the order dated 30/07/2024 (Annexure P/1) by which the appointment of petitioner on compassionate basis has been cancelled on the ground that the death certificate produced by the petitioner was not issued in accordance with law.

Learned counsel appearing for the petitioner submits that the petitioner submitted proof of death of her husband by producing the death certificate issued by the Gram Panchayat Nagrodi, Bilha, Bilaspur and on the basis of the application submitted by the petitioner, she was appointed on the post of Chowkidar on compassionate ground vide appointment order dated 18/10/2016, however, on a complaint being made by Shri Santosh Singh Parihar and Shri Rajneesh Sahu, the appointment of the petitioner was reexamined and after some internal enquiry, the services of the petitioner has been terminated on the ground that the death certificate produced by the petitioner was not issued as per Rules.
4. Looking to the dispute with regard to the death of husband of the petitioner, this Court vide order dated 27/03/2025, has directed the SDO, Bilha to conduct an enquiry regarding the death of
3 / 3 husband of the petitioner and submit a report thereof. Pursuance to the same, the SDO, after conducting an enquiry by certifying the death of the petitioner’s husband, has submitted his report on 15/04/2025.

Learned counsel for the respondents has no objection in respect of the report submitted by the SDO i.e. with regard to the death of petitioner’s husband.
6. I have heard learned counsel for the parties and perused the documents.
7. As the death of husband of the petitioner has been certified by the SDO as such there is no dispute left regarding the same.
8. Accordingly, the writ petition is allowed. As the dispute regarding the death of the petitioner’s husband is resolved, the impugned
order dated 30/07/2024 (Annexure P/1) deserves to be and is hereby quashed.
9. The respondent authorities are directed to reconsider the order dated 30/07/2024 and by looking to the report submitted by the SDO, pass necessary order to reinstate the petitioner with all the consequential benefits, within a period of 25 days from the date of receipt of a copy of this Order.
