(Oral) Prayer in this criminal writ petition is for issuance of a writ in the nature of mandamus, directing the respondents to pre-maturely release the petitioner on the expiry of more than 14 years of actual sentence and more than 18 years of total sentence including remission period as per the Notification dated 13.08.2008 (Annexure P-3). Learned State counsel, on instructions from Head Warden Radhe Shyam of Central Jail, Hisar, submits that the present petition filed by the petitioner is pre-mature. The case of the petitioner for pre- mature release has already been sent to the competent authority and the same shall be decided within a period of 08 weeks. In view of the above, learned counsel for the petitioner wishes to withdraw the present criminal writ petition. Dismissed as withdrawn. Liberty is granted to the petitioner to approach this Court again in case the case of the petitioner for pre-mature release is rejected by the competent authority.
