The petitioner is apprehending his arrest in connection with C.P. Case No. 632 of 2024, registered for the offences under Section 498-A of the Indian Penal Code, pending in the court of learned CJM, Deoghar.

Learned counsel appearing for the petitioner submits that the petitioner happened to be the husband of the informant and false allegation is made against him of torture. He next submits that the informant has already filed the maintenance case, being O.M.C. No. 104 of 2024, where in her evidence, she has disclosed that she does not want to reside with her husband.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the petitioner happened to be the husband of the informant.

Considering that the petitioner happened to be the husband of the informant and in the maintenance case, filed by the informant, she has herself deposed that she does not want to live with the petitioner, in that view of the matter, the petitioner, above named, is
directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on the appropriate terms and conditions or on sureties as may deem fit and proper by the learned Court.
