JUSTICE RAJESH MAZUMDAR ORDER 14.08.2026 Heard Ms. Vanneihsiami, learned Addl. PP for the State of Mizoram. By the order dated 23.06.2026 this Court had noticed that notices upon respondent Nos. 1 & 2 had been served and none had appeared. On 16.07.2026, this Court, for the ends of justice had directed the matter to be listed today. None appears for respondent Nos. 1 & 2 today also. This is an application praying for leave to file the connected Criminal Appeal against the impugned acquittal Judgment & Order dated 27.02.2025 passed by the learned Presiding Officer, Fast Track Court (Rape and POCSO) Act, Aizawl, Mizoram in S.C No. 38/2024 (Crl.Trl.No. 569/2024) arising out of All Women P.S Case No. 18/2024 u/s 10 POCSO Act r/w Section 354(A) (2). The learned Addl. PP has submitted that there are good grounds for Page No.# 3/3 appeal against the impugned order. She has further submitted that there was enough evidence adduced to prove the guilt of the accused person, and failing to appreciate such evidence, the learned Trial Court had committed error in acquitting the accused. I have gone through the impugned Judgment and I find it a fit case to allow this petition, granting leave to the State to proceed with the connected Criminal Appeal. Accordingly, the I.A.(Crl.) No. 44/2025 is allowed. It has been submitted that there is an application for condoning the delay in filing the connected appeal. JUDGE Comparing Assistant
