Mr. P.S. Goverdhan, Senior Advocate with Mr. Rakesh Thakur, Advocate, for respondents No.1 to 3. CMP No.30443 of 2025 The present appliation has been filed for deletion of name of appellant No.1, i.e., Smt. Geeta Devi. No reply is intended to be filed on behalf of the non- applicants and they have no objections, if in case the application is allowed and the name of appellant No.1-Smt. Geeta Devi, as is being prayed in the application, is ordered to be deleted from the array of the parties. Heard learned counsel for the parties and perused the record. Appellant No.1-Smt. Geeta Devi is stated to have expired on 19.03.2021, a fact which is evident from the Death Certificate appended along-with the present application. She is succeeded by her two sons, namely Yashwant Kumar and Prakash Chand, who are already on record as appellants No.2 and 3. In view of the fact that the estate of deceased appellant No.1- Smt. Geeta Devi is duly represented by her two sons, in whom the right to sue survives/inheres, the present application is allowed. The name of deceased appellant No.1 is ordered to be deleted from the array of the parties, subject to all just exceptions. The application stands disposed of.
