This criminal miscellaneous bail application has been filed by the petitioner under Section 483 of BNSS, 2023 in respect of FIR No.67/2025 registered at Police Station Makbara, District Kota City for the offence punishable under Section 109(1) of BNS. 2. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the FIR in question and whereas, he has not committed any offence whatsoever. Even otherwise, the allegation alleged against the petitioner is only of inflicting a single injury, which was never repeated by the petitioner. Learned counsel also submits that in the instant case, if any, the injury has occurred on account of sudden provocation and after completion of investigation, charge-sheet has already been filed. The petitioner is behind the bars since 02.10.2025, [2025:RJ-JP:51501] (2 of 2) [CRLMB-16241/2025] therefore, he is no longer required for any custodial interrogation and trial is likely to take considerably long time. Hence, a prayer has been made to enlarge the petitioner on bail. 3. Learned Public Prosecutor has vehemently opposed this bail application and in the light of the fact that after completion of investigation, charge-sheet has been filed and there is only one allegation of inflicting a single injury against the petitioner, this Court without expressing any opinion on the merits and demerits of the case, deems it just and proper to enlarge the petitioner on bail. 4. Accordingly, this Bail Application is hereby allowed. The accused-petitioner Aabid S/o Shri Yamin shall be released on bail in pursuance of FIR No. 67/2025 registered at Police Station Makbara, District Kota City on furnishing a personal bond of Rs. 1,00,000/- along with two sureties of Rs.50,000/- each. That apart, the accused-petitioner shall also follow the conditions as under:- (i) He shall not tamper with any evidence, nor would influence the witnesses in the case. (ii) He shall not leave the country without prior permission of the Court. (iii) He shall co-operate in the trial and shall attend each and every date of hearing in the trial, until and unless his presence is exempted by the trial Court. (ANAND SHARMA),J DIVYA /197
