1. Heard Mr. Akshit Singh Hora, learned counsel for the petitioners. Also heard Mr. Malay Jain, learned Panel Lawyer for respondent No. 1 / State.
2. The present petition has been filed by the petitioners with the following relief(s):-
“It is therefore prayed that this Hon'ble Court may kindly be pleased to allow the Criminal Miscellaneous Petition and may kindly be pleased to quash the First Information Report No. 54/2019 registered at P.S. Suhela, Dist- Baloda Bazar-Bhatapara (C.G.) registered on 24.02.2019 for the offence punishable U/s 498 (A) (B), 34 of I.P.C. and 3 & 4 of Dowry Prohibition Act, charge sheet No. 107/2024 dated 25.03.2019 filed for the offences punishable U/s 498 (A) (B), 34 of I.P.C. and 3 & 4 of Dowry Prohibition Act, the order of taking cognizance by the learned Judicial Magistrate First Class Simga on 28.03.2019,
order of framing of charge against the petitioner dated 25.04.2019 and may kindly be pleased to quash the order dated 09.09.2024 passed by learned Judicial
3 Magistrate First Class Simga wherein the application for quashing of criminal proceedings on the basis of compromise has been rejected, in the interest of justice.”

Learned counsel for the petitioners submits that the dispute between petitioners and respondent No.2 has been amicably settled subject to fulfillment of terms and conditions of the compromise entered between the parties vide deed of compromise dated 05.09.2024 and the same has been annexed as Annexure P/5 in the present petition.

Considering the settlement which has been arrived at between the parties as has been mentioned in compromise deed dated 05.09.2024, impugned FIR bearing Crime No. 54/2019 dated 24.02.2019 registered at Police Station Suhela, District- Baloda Bazar-Bhatapara (C.G.) for the offence punishable under Section 498(A)(B), 34 of the IPC and Section 3 & 4 of the Dowry Prohibition Act, charge-sheet No.107/2024 dated 25.03.2019 and all consequential proceedings arising therefrom including order taking cognizance dated 28.03.2019 issued by learned JMFC Simga and order framing charge against the petitioners dated 25.04.2019, are liable to be quashed, subject to fulfillment of terms and conditions as mentioned in compromise deed dated 05.09.2024 entered into between the petitioners and respondent No.2. It is made clear that all the subsequent proceedings originated from the said FIR, shall also stand set aside.

5. Accordingly, the instant petition under Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023 is allowed to the extent indicated hereinabove. Sd/- Sd/- (Bibhu Datta Guru)
