No.12/RCA-ACB-NLR-2016 dated 20.10.2016, which is arbitrary, bad and illegal, violation of Article 14 of The Constitution of India and also contrary to the law. Consequently set aside the notice by direct the 2nd respondent to issue Show-cause notices to the owners of the properties, in whose possession the property documents were seized by the 2nd respondent at the time of registering of offence in the interest of justice and pass

ORDER:
The instant Writ Petition is filed by the Petitioner seeking indulgence of this Court under Article 226 of the Constitution of India for the following relief:
“ ... to issue a writ or order or direction, more particularly one in the nature of WRIT OF MANDAMUS, declaring the action of the 2nd respondent in issuing Show cause notice dated 02.07.2018 issued to the petitioner, calling for explanation in respect of assets acquired by 3rd parties, without issuing any notice to the real owners, though the case was registered vide F.I.R. No.12/RCA-ACB-NLR-2016 dated 20.10.2016, which is arbitrary, bad and illegal, violation of Article 14 of The Constitution of India and also contrary to the law.
