1. PUBLIC PROSECUTOR (AP) The Court made the following:
2
THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 9496/2022
ORDER:
The instant petition under Section 482 of the Code of Criminal Procedure, 1973 (in short, “Cr.P.C.”) has been filed by the Petitioner/ Accused No. 2, seeking quashment of order dated 24.05.2022 in S.C.No.462 of 2012 on the file of Principal Assistant Sessions Judge, Madanapalle.
2. Heard Sri K. Nagendra Reddy, learned Counsel representing Sri D.S.N.V.Prasad Babu, learned Counsel for the Petitioner and Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State. Notice served on the respondent No.2, none appeared.
3.
Learned Counsel for the petitioner would submit that the petitioner herein along with other accused filed Crl.P.No. 13743 of 2014 and obtained stay of all further proceedings against them in S.C.No. 462 of 2012 on the file of Principal Assistant Sessions Judge, Madanapalle, Chittoor District. Learned Counsel would further submit that while so, learned Trial Judge issued Non- Bailable Warrant against the petitioner who is Accused No.2 in the said case.
Learned Counsel would further submit that the Trial Court having knowledge about the orders passed by this Court dated 12.06.2015 giving stay of all further proceedings issued Non-Bailable Warrant against the petitioner which is not tenable under law.
4. Learned Assistant Public Prosecutor brought to the notice of this Court that the case against the petitioner and other Accused has been quashed by
3
orders of the Coordinate Bench of this Court in Crl.P.No. 13743 of 2014 dated
08.11.2024. The copy of the order is placed on record. The Order would show that A-5 and A-6 died during the pendency of the said application. The case against them is abated. Coming to the case against the petitioners/A-1 to A-4, the petition is allowed quashing the proceedings in S.C.No.462 of 2012 on the file of Principal Assistant Sessions Judge, Madanapalle, Chittoor District. Admittedly, the petitioner herein is Accused No.2, against him the case has been quashed. In that view, no further orders are required in this matter. The Non-bailable Warrant issued against the petitioner is automatically recalled.
5. In the light of aforementioned premises, the petition is disposed of, since no further orders are required in this matter as the main case against the petitioner itself is quashed by virtue of the final order passed in Crl.P.No. 13743 of 2014 dated 08.11.2024 by the Coordinate Bench of this Court.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed. __________________________________________ DR. JUSTICE VENKATA JYOTHIRMAI PRATAPA Date: 21.02.2025 UPS
