[2025:RJ-JP:40930] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 4131/2025 Rakesh Yadav @ Rakesh Lisadiya S/o Shri Banwari Lal Yadav, Aged About 35 Years, R/o Suryanarayan Ki Dhani Tan Village Lisadiya Police Station Shirmadhopur, District Neem Ka Thana, Rajasthan (Petitioner Is In Judicial Custody At Central Jail Jaipur). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Manish Gupta For Respondent(s) : Mr. Jaiprakash Tiwari, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 08/10/2025 1. The petitioner has filed this bail application under Section 483 of BNSS in FIR No.103/2024 registered at Police Station Daulatpura (Jaipur-Ajmer Highway), District Jaipur City West for offence under Sections 332, 353, 394, 224, 307 IPC and Section 5/27 of Arms Act. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that no injury was caused by the petitioner to any police official, conversely, he has got injury on his leg by fire from police. He again submits that the petitioner is behind the bars since 22.11.2024 and charge-sheet has been filed, the trial of [2025:RJ-JP:40930] (2 of 2) [CRLMB-4131/2025] the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody and the bail application of the petitioner may be allowed. 4. On the contrary, learned Public Prosecutor has vehemently opposed the bail application by submitting that the petitioner is a habitual offender having 23 criminal antecedents of like nature. He contended that police has arrested the petitioner against whom prize money of Rs. 1 lac was declared. The petitioner has tried to run away from the custody of the police and in pursuance thereof, he snatched the pistol of one constable and started firing, therefore, in such a situation, the person with multiple criminal antecedents in his credit and has courage to attack on the police officials does not deserve any sympathy and his enlargement on bail may adversely affected the society at large. 5. On consideration of the rival submissions and material available on record and in the light of submission made by learned Public Prosecutor especially the fact that petitioner fired on the police official and has a criminal past of 23 cases of like nature but without expressing any opinion on merits/demerits of the case, I am not inclined to grant benefit of bail to the petitioner. 6. Consequently, the bail application under Section 483 B.N.S.S. is dismissed. (PRAMIL KUMAR MATHUR),J bmg/37
