JUSTICE KALYAN RAI SURANA ORDER 13.08.2026 Heard Ms. Lalropari, learned counsel for the applicant. Also heard Ms. H. Lalrosangi, learned counsel for the respondent. 2. The applicant is the appellant in the connected appeal, which has been filed against the money decree for a sum of Rs. 10,00,000/- with 12% interest passed vide judgment and decree dated 24.09.2025 by the learned Civil Judge (Senior Division)-III, Aizawl in Money Suit No. 35/2021. 3. The Interlocutory Application has been filed for stay of execution of the decree. 4. As a money decree has been passed in Money Suit No. 35/2021, stay of execution of the decree is subject to the conditions mentioned hereinafter. 5. The execution of the judgment and decree dated 24.09.2025 passed in Money Suit No. 35/2021 by the learned Civil Judge (Senior Division)-III, Aizawl shall remain stayed subject to the condition that, within a week from the date of this order, the applicant shall furnish security for a sum of Rs. Page No.# 3/3 10,00,000/- before the Court of the learned Civil Judge (Senior Division)-III, Aizawl, to the satisfaction of the learned Court. 6. Moreover, apart from furnishing security, the applicant shall file an affidavit disclosing her assets, which shall also be filed before the learned Civil Judge (Senior Division)-III, Aizawl. 7. The said learned Court, on being furnished with the security as well as the disclosure affidavit, shall record the same in the proceedings of Money Execution Case No. 171/2026, instituted and pending before the Court of the learned Civil Judge (Senior Division)-III, Aizawl. 8. The applicant is put on notice that if the aforesaid two conditions are not complied with, the stay shall stand vacated without any reference to any further order of this Court, and it shall be open to the learned Civil Judge (Senior Division)-III, Aizawl to proceed with the execution. 9.
