1. The petitioner has filed this writ petition on the following relief:-
“(i) That this Hon'ble Court may kindly be pleased to allow the present writ petition preferred by the petitioner and call for the records pertaining to the present case. (ii) That this Hon’ble Court may kindly be pleased to issue an appropriate writ to the respondents to ensure immediate compliance with the Tehsildar’s order dated Digitally signed by JYOTI JHA Date: 2025.07.31 11:12:28 +0530
2 19.05.2025 and handover of physical possession to the petitioner. (iii) That any other order/relief which this Hon'ble Court may deem fit, proper and just in the facts and circumstances of the present case may also kindly be awarded to the petitioner in the ends of justice along with the cost of the petition may kindly also be awarded to the petitioners.”

Counsel for the petitioner submits that the petitioner is the recorded Bhumi Swami(Landowner) of the land bearing survey numbers 617/28(area 0.0200 ha) and 617/30(area 0.0160 ha) as per Form B-1 Khasra. The said land was lawfully purchased by the petitioner from Harendra Sheel. However, despite the transfer, unlawfully obstruction has been made for the petitioner from taking possession and initiating construction on land. Upon facing such obstruction, the petitioner submitted a complaint before the Tehsildar, who passed a order dated 19/05/2025, directing that possession of the land be handed over to the petitioner through the Patwari within 10 days. However, no compliance was made till 27/05/2025, petitioner submitted application before the Sub-Divisional Officer highlighting the non- compliance.
The Tehsildar sent a notice dated 27/06/2025 to Paran Sheel brother of Harendra Sheel vacant the possession from the land before 29/06/2025, even after this no compliance has been done, the petitioner also approached the District Collector through the Jandarshan programme and submitted an application bearing token
3 no.2170125000501/B-121/2024-25.Even after this, no steps have been taken to hand over the lawful possession to the petitioner. Therefore he prays for a direction to the decide the application dated 14.07.2025. 3. Learned State Counsel submits that in view of the limited prayer made by the learned counsel for petitioner seeking direction to respondent no. 2 to consider the pending application dated 14.07.2025, she is having no objection to the limited prayer and if the claim of the petitioner is pending, it will be considered in accordance with law. 4. Heard learned counsel for the respective parties and perused the record with utmost circumspection. 5. Considering the facts and circumstances of the case instead of keeping this petition pending, I find it appropriate to dispose of the same at this stage directing the respondent no. 2 to consider/decide the application (Annexure P/4) dated 14.07.2025 of the petitioner as expeditiously as possible in accordance with law. 6. With the aforesaid direction, the present petition is disposed of. Sd/-
