The petitioner is apprehending his arrest in connection with Gamharia P.S. Case No. 12 of 2024, registered for the offence under Sections 147, 353, 341, 504, 506 and 427 of the Indian Penal Code and Sections 139 and 140 of the Electricity Act, pending in the court of learned District and Additional Sessions Judge-II, Seraikella.

Learned counsel appearing for the petitioner submits that one Raj Kumar came in contact with 11000 Volt Electric Wire as a result of which, he died and the same resulted in assemblage of large number of persons, who demonstrated and also demanded compensation apart from damaging the articles, which resulted in disconnection of electricity for 6.35 hours, causing loss to the electricity department. He next submits that there is general and omnibus allegation against all the accused persons. He further submits that in the similar circumstance, the other co-accused persons have already been provided the privilege of anticipatory bail in A.B.A. Nos. 2503, 2535 and 2502 of 2024 by the co-ordinate bench.

Learned counsel appearing for the JUVNL submits that the people has been put in trouble due to interference made by the demonstrators, as the electricity was cut for certain hours.

Considering that there are general and omnibus allegation against the assembly of the people, who were demonstrating against the death of one Raj Kumar, who died due to coming in the contact of 11000 Volt Electric Wire and further in the similar circumstance, the other co-accused persons have already been provided the privilege of anticipatory bail in the aforementioned A.B.As, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, named above, is directed to surrender before the learned court within four weeks from today and in the event of his/her surrender / arrest, the petitioner, named above, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty-five thousand), with two sureties of the like amount each, to the satisfaction of learned District and Additional Sessions Judge-II, Seraikella, in connection with Gamharia P.S. Case No. 12 of 2024, subject to conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
