In course of hearing Mr. Basu Mallick, learned advocate appearing on behalf of the alleged contemnor has handed over a server copy of the order dated 25.08.2025 as passed by a Division Bench of this Court in FMA 1244 of 2025 wherefrom it reveals that the said Division Bench has fixed the hearing of the said appeal on September 15, 2025. 3. Mr. Basu Mallick, learned advocate appearing on behalf of the alleged contemnor submits before this Court that since the Hon’ble Division Bench is seisin over the said appeal, an accommodation may be granted. 4. Such prayer is, however, opposed by Mr. Mukherjee, learned advocate appearing on behalf of the petitioner. 5. On careful consideration of the entire materials as placed before this Court and after hearing the learned advocates for the contending parties, this Court is inclined to allow the prayer for adjournment. 2 6. Let the matter be listed December 8, 2025 under the same heading. 7. It is made clear that in the event, the alleged contemnor fails to bring any stay order on the adjourned day, this Court shall have no other alternative but to issue rule of contempt against the alleged contemnor.
