This is an application filed by the petitioners-State under Article 226 of the Constitution of India read with Section 114 of the CPC for review of the order dated 10.09.2024 passed by this court in W.P(C) 160 of 2024. Mr. Sarma, learned Additional GA appearing for the petitioner-State has submitted that the petitioners have filed the instant review petition alongwith application for condonation of delay and also an application for staying the operation of the order dated 10.09.2024. Mr. Sarma, learned Additional GA has also submitted that the order passed by this court has already been considered by the appointing department but, the competent authority of the department apprehends of facing contempt proceeding. Learned Additional GA also has submitted that the implementing authority has not been impleaded or incorporated in the writ petition and the State department is only the recommending authority. I have considered the submissions of learned Additional GA. In my opinion, the review petitioners have failed to make out a case of review as none of the submissions attract the ingredients of Order XLVII Rule 1 of the CPC and Section 114 of the CPC. Moreover, the order dated 10.09.2024 passed by this court has already been considered and the decision has already been communicated. In view of the above, the instant review petition deserves no merit and accordingly stands dismissed. Pending application(s), if any, also stands dismissed.
