In nutshell, the grouse of the petitioner as has been highlighted in the petition and further canvassed by Mr. A.K. Gupta,
learned counsel for the petitioner, is that though petitioner has been granted work charge status after his having completed eight years daily wage service with 240 days in each calendar year on notional basis, but yet his pay is not being re-fixed.

Though, respondent-State despite their being sufficient opportunity has failed to file reply, but learned Additional Advocate

2 General fairly states that order with regard to pay fixation, if not already issued, shall be issued expeditiously.

In view of the above, nothing remains to be adjudicated in the instant proceedings and accordingly, same are closed. The respondents are directed to re-fix the pay of the petitioner on account of conferment of work charge status on notional basis. However, while doing so, authority concerned may take note of Rule 9(31) of FRSR, which provide that increments qua the period benefit has been given on notional basis are also required to be taken into consideration. Needful in terms of instant order shall be done within a period of two weeks. Pending applications, if any, also stand disposed of.
