Neutral Citation No. - 2025:AHC:49483-DB Court No. - 42 Case :- CRIMINAL MISC. WRIT PETITION No. - 6311 of 2025 Petitioner :- Dheeraj Yadav Respondent :- State Of U.P And 3 Others Counsel for Petitioner :- Rakesh Chandra Counsel for Respondent :- G.A. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Prashant Kumar,J. 1. Heard Sri Rakesh Chandra, learned counsel for the petitioner, Sri Prateek Srivastava, learned counsel for the informant and learned A.G.A. for the State- respondents. 2. Present writ petition has been preferred for quashing the First Information Report dated 13-03-2025 registered as Case Crime No. 253 of 2025, under Sections 191 (2), 191 (3), 190, 115 (2), 333, 109(1), 351(3), 7 Bharatiya Nyaya Sanhita, 2023, Police Station Robertsganj, District Sonebhadra. 3. Learned counsel for the informant raised an objection regarding the maintainability of the writ petition on the ground that an earlier petition had been filed by a co-accused, invoking the writ jurisdiction to challenge the validity of the impugned F.I.R. in Criminal Misc. Writ Petition No. 5890 of 2025 (Shivam Singh vs. State of U.P. and others). After substantial arguments were advanced, the Court declined to entertain the writ petition for quashing the impugned first information report. Consequently, learned counsel for the petitioners submitted that the petitioner does not wish to press the present writ petition, and the same may be dismissed as not pressed, with liberty to avail the remedy as available in law. 4. Confronted with the situation, learned counsel for the petitioners states that the petitioner does not want to press the writ petition and the same may be dismissed as not pressed with liberty to invoke the remedy as available in law. 5. Accordingly, the writ petition is dismissed as not pressed. Needless to say that in case the petitioner is aggrieved, he may avail the remedy as available in law.
