(Oral) Applicant Rahul Mishra is in judicial custody FIR No. 507 of 2019, under Section 302 of IPC, Police Station Rudrapur, District Udham Singh Nagar. He has sought his release on bail. 2. Heard learned counsel for the parties and perused the record. 3. This is the third bail application. The first bail application, being BA1 No.1877 of 2020, was rejected on 15.06.2022 and the Second Bail Application being BA2 No.110 of 2024 was rejected on 16.04.2024. 4. It is argued that the applicant was taken into custody on 24.09.2019; he is in custody for more than five years now; till date, out of 20 prosecution witnesses, only 8 witnesses have been examined. 2 5. This fact is admitted by the learned State counsel. 6. Having considered the entirety of facts, this Court is of the view that the applicant deserves to be enlarged on bail. 7. The third bail application is allowed. 8. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.
