Per contra, learned AGA opposed the prayer for bail and submitted that apart from the present case, applicant is having criminal history of two other cases including cases under section 109 BNS and Arms Act but he fairly conceded that applicant was not having any previous criminal history and when he was arrested in the present matter then simultaneously in both the cases, he has been made accused. 6. He could not dispute the other arguments on facts advanced by learned counsel for the applicant. 7. I have heard learned counsel for the parties and perused the record of the case. 8. From the record it reflects that nobody was named in the FIR but during investigation applicant has been made accused in the present matter and it appears except the confessional statement of the applicant, there is no other evidence against the applicant on record. 9. Further, however, it reflects that apart from the present case, applicant is also having criminal history of two other cases but he was not having any previous criminal history and it appears in both the above cases, relate to offences under section 109 BNS and under provisions of Arms Act he has been made accused when he was arrested in the present matter. 10. Further in the present matter, applicant is in jail since 29.8.2024 i.e. for last more than 7 months. 11. Therefore, considering the facts and circumstances of the case, discussed above, in my view, applicant is entitled to be released on bail. 12. Accordingly, without expressing any opinion on the merits of the case, the instant bail application is allowed. 13. Let the applicant-Rahul, be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions:- (i) The applicant shall appear before the trial court on the dates fixed, unless his personal presence is exempted.
