V. ANJARIA and HON'BLE MR JUSTICE M.I.ARUN ORAL JUDGMENT (PER: HON'BLE THE CHIEF JUSTICE MR. JUSTICE N. V. ANJARIA) The directions in the order of learned Single Judge dated 25.04.2024 in Writ Petition No.87 of 2021 relates to restoration of the electricity supply which is an essential service, to the flat of the complainant-petitioner. 2. Paragraphs 4 and 5 of the order read as under, "4. Therefore, the respondents 1 to 4 are hereby forthwith directed to restore power supply to the petitioners' flats, subject to the petitioners sharing the bill amount proportionately to the extent of power consumed by them. 5. Respondent No.5 is at liberty to recover all the dues incurred proportionately from the petitioners for servicing power supply to the apartment complex, if they are otherwise liable to in accordance with the law." 3. Thus, as per paragraph 4, the complainant is expected to perform his part of the obligation by sharing the bill amount proportionately and pay the same to the respondent electricity - 4 - NC: 2025:KHC:10851-DB CCC No. 1428 of 2024 company which is a condition to be abided by him for getting the restoration of power supply. 4. Learned advocate Mr. B.N. Anjan Kumar for the complainant fairly stated that once the respondent-Company intimates about the proportionate bill amount, the same shall be paid within one week. 4.1 It was stated by learned advocate for the respondents that intimation about the proportionate payments will be given within one week from today. 4.2 Learned advocate for the complainant stated that if the proportionate bill is not paid, the same shall be paid within two days once the intimation is received as above from the respondent. 4.3 Upon such compliance, if not done so far, respondent Nos.1 to 3 shall forthwith comply with the directions of learned Single Judge by restoring the power supply to the complainant's flat within two days thereafter. 5. The contempt proceedings stand disposed of as above. - 5 - NC: 2025:KHC:10851-DB CCC No. 1428 of 2024 If the compliance is not done by the authorities concerned of supplying the power even after the payment of proportionate bill by the complainant, the respondents shall be exposed to aggravated form of contempt.
