HBKM,J W.P.No.37558 of2022 The Court made the following Order: Heard the learned counsel for the petitioner, the learned Assistant Government Pleader for the respondent Nos.1 to 5 and the learned counsel appearing for the 6'^ respondent. 2. This writ petition was filed questioning the action of the respondent Nos.3 to 5 in trying to dispossess the petitioner from the agricultural land to extent of Ac.3-32 cents in S.No.175-A situated at G.Venkatampall i Village, Peddavadugur Mandal, Anantapuram District. an On the other hand, the learned Assistant Government Pleader relying upon the counter of the respondent submits that the land in S.No.175-A in an extent of Ac.9-97 cents of G.Venkatampalli Village is classified as G.D.
“Patta Land” as per RSR of the village, possession and enjoyment of the lands and obtained pattadar pass books and title deeds as per revenue records. The details of the pattadars are as under:

HBKM,^ W.P.N0.37558 of2022 So far as the writ petitioner is concerned, the enjoyment to an extent of the land was shown as Ac.3-32 cents in Sy.No.175-A vide IB Khata No.37. While so, the 6*'^ respondent submitted a representation to the 4'*^ respondent on 30.09.2022 stating that he is having the land to an extent of Ac.2-40 cents in Sy.No.281-A1 and Ac.2-59 cents in Sy.No.282-3 of G.Venkatampalli Village, which were assigned lands vide IB Khata No.191 and he is in continuous possession and enjoyment of the same by raising rain-fed crops through cultivation. He has been using the existing rasta to approach his agricultural fields through the land in Sy.No.175-A for the last so many years. There is no way into the rasta except the existing rasta for usage of all the farmers including the 6^^ respondent. Consequently, it got enquired in the month of October 2022 by the Mandai Surveyor and the V.R.O. of the G.Venkatampalli Village and they reported that the rasta in question is in usage for the last so many years, though it is not a marked rasta in the village plan.
But recently, the petitioner closed the existing rasta in his land in Sy.No.175-A. As such, the 4*^ respondent issued the office proceedings in Rc.No.B-360/2022 dated 10.11.2022 to pass through the border “Gattu” in Sy.No.175-A. The 4*^ respondent further averred that the respondent Nos.3 to 5 are not dispossessing the petitioner from the agricultural land in an extent of Ac.3-30 cents in Sy.No.175-A situated at G.Venkatampalli Village, Anantapur District. By replying upon the counter of the S**" respondent, the learned counsel for the respondent supports the contention of the 4*^ respondent as stated above. 4. 5 HBKM,J W.P. No. 37558 of2022 In view of the above said facts and circumstances, since there is no threat of dispossession from the subject land to the petitioner, no further orders are necessary in this petition. 5. 6. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs. Interim order, if any, deemed to have been vacated.
