2. Petitioner has been made accused in connection with Rajganj P.S. Case No. 59 of 2023 corresponding to G.R. No.1416 of 2024 for the offences registered under Sections 414/34 of the IPC and 4/4(1)(A)/21 of the MMDR Act and Rule 7/9/13 of the Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules 2017, pending in the Court of learned Chief Judicial Magistrate, Dhanbad.
3. On 08.10.2023, Rajganj Police on the basis of confidential information, seized a vehicle bearing Registration No.UP-70GT-1189 from Indian Oil petrol pump near Yadav Raj Hotel. On search 30 tonnes of illegal coal was found loaded on the said vehicle.
4. It was submitted that the only allegation against the petitioner is that he had talked to the owner of the vehicle on mobile.
5. In view of the submission made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Dhanbad, in connection with Rajganj P.S. Case No. 59 of 2023 corresponding to G.R. No.1416 of 2024.
