1. Heard Mr. Apoorva Tripathi, learned counsel for the petitioner. Also heard Mr. Sangharsh Pandey, learned Govt. Advocate for the respondents/ State. 2. The petitioner has filed this petition praying for following relief:-
“A. Call for the records of FIR No. 0385/2025, registered at Police Station Gandhi Nagar, Ambikapur, District Sarguja (C.G.) and the order dated 28.03.2025 passed by the learned Chief Judicial Magistrate, Ambikapur. B. Quash the impugned order dated 28.03.2025 passed by the learned Chief Judicial Magistrate, Ambikapur, directing the registration of FIR. C. Quash the First Information Report bearing FIR No. 0385/2025 dated 08.07.2025, registered Police Station Gandhi Nagar, Ambikapur, District Surguja (C.G.) and all consequential proceedings arising therefrom, qua the petitioner; in the interest of justice. D. Pass any other and further order(s) as this Hon’ble Court may deem fit and proper in the facts and circumstances of the present case, in the interest of justice.”
3. At the time of hearing, this Court has observed that the petitioner has filed the present petition without appropriate prayer which is defective one, therefore, we are not inclined to entertain the
3 present petition with such a vague and sketchy prayer as there is offence in the prayer have not mentioned to which learned counsel for the petitioner seeks permission of this Court to withdraw the present petition with liberty to file afresh with proper prayer. 4. Learned State counsel has no objection. 5.
In view of the submissions made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with the aforesaid liberty, as prayed for subject to depositing a sum of Rs. 1,000/- as cost by the petitioner in the Registry of this Court within a period of one week from today and the said amount shall be transmitted to the Government Multi-Disabled Home, Village Pendri, District- Janjgir- Champa (C.G.). 6.
