Civil Review Petition is preferred by the appellant defendant dissatisfied from order dated 12.01.2024 in S.B Civil First Appeal No. 870/2004 passed by this Court wherein on the basis of report from mediation centre about settlement of dispute between the parties the appeal was dismissed as withdrawn in pursuant to communication to this Court. 2. Learned counsel for appellant defendant submits that in fact the compromise between the parties was with regard to nullifying the effect of judgment and decree passed by the trial court and erroneously instead of recording no objection on part of respondent plaintiff to allow the appeal it has been recorded that the appeal be dismissed as withdrawn. 3. Learned counsel for petitioner and respondent submits that the parties are present before this Court and they have executed the compromise deed for amendment and correction in earlier compromise between the parties and on the basis of amended (2 of 2) [CRW-36/2025] compromise deed the review petition and S.B. Civil First Appeal be disposed of. 4. The parties are directed to appear before the Registrar (Judicial) at 3:30 p.m. The Registrar (Judicial) is directed to attest and verify the compromise and list the matter before this Court today itself.
