The present petition under Section 528 of BNSS has been filed for a direction to the trial Court to expedite the trial in Criminal Case No.209/2021 (State v. Shivcharan Prasad Rathore & others) pending before the JMFC, Katghora, District Korba (CG). 2. From the material available on record it is evident that the charge sheet was filed on 06.12.2020. The proceeding of the trail Court was stayed by order dated 08.02.2022 passed in CRMP No.190.2022 (Shivcharan Prasad Rathore v. State of CG & Anr.). CRMP No.190/2022 was finally disposed on 13.01.2025. Thereafter, the trial Court proceeded with the case. Hence, it is not found to be a fit case to exercise the inherent power of this Court under section 482 CrPC/528 of BNSS. 3. Thus, the present CRMP deserves to be and is accordingly dismissed at the motion stage. 4.
