The petition coml'ng on for hearI'ng, upon perusing the petition and the grounds filed in support thereof and upon hearing the arguments of sri SRINIVASA RAO NARRA, Advocate for the petI'tI'Oner and of PUBLIC PROSECUTOR for the Respondent and the court made the following,® 1 HON'BLE SRI JUSTICE K.SURESH REDDY CRIMINAL PETITION No. 9722 OF 2023 ORDER: -s criminal petition, under section 438 Cr.P.C., is filed by the petitioner-accused No. 13 seeking to release him On bail in the event of arrest in crime No. 556 of 2023 of Ongole Taluk Police Slat.Ion, Prakasam District, registered for the OffenCeS Punishable under Sections 420, 468 and 471 read w-Ith Section 34 IPC. 2. Heard Sri Narra Srinivasa Rao, learned counsel appearing for the petitioner-accused No. 13, and learned Additional Public prosecutor appearing for the respondent-state. 3. It is alleged by the prosecution that accused Nos. 1 to 4 created fake title deeds, fake birth and death certificates and fake rubberstamps and transferred certain properties in favour of different persons. The police have seized the above fake documents from the possession of accused Nos. 1 to 41 0n the basis of the said allegation, the present crime has been registered. During the course of investigation, accused Nos. 1 to 4 said to have confessed that the petitioner 'IS also One Of the members in the present crime. JB1- i-th '` . -.ii-` \\ 2 // 4. Learned counsel appearing for the petI-tI'Oner-accused No.13 contends that no specific role has been attributed to the petitioner- accused No. 13 and that the petitioner-accused No. 13 came to be I-mplicated only on the confession made by accused Nos. 1 to 4. He therefore requests this court to grant anticipatory bail to the Petitioner-accused No. 13. 5. On the other hand, learned Additional Public Prosecutor opposed the petition on the grounds that the petitioner-accused No. 13 came to be implicated on the basis of confession made by accused Nos. 1 to 4 and that the matter is still under investigation to find out the role of the petI-tiOner-accused No. 13. 6. In view of the above facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner- accused No. 13 with certain conditions. 7. The petitioner-accused No. 13 is, therefore, directed to surrender before the Station House Officer, Ongole Taluk Police Station, Prakasam District, within a period of two weeks from today. On such surrender, the petitioner-accused No. 13 is ordered to be enlarged on bail on his executing a personal bond + 3 for Rs.20,000/- W'lth two Suret'leS for the l'lke Sum each tO the satisfact-Ion of the station House Offllcer, Ongole Taluk Police station. After release, the Petitioner-accused No. 13 is d-lreCted tO report before the Slat-Ion House Off|lcer, OngOle Taluk Police station, once in a week ,I.e, on every Monday between 10 a.m. and 1 p.m. for a Per-tod Of three months.
