Gupta, Advocate Ms. Shruti Shekhar, Advocate Mr. Nillohit Choubey, Advocate Ms. Sanya Kumari, Advocate ------ 4/07.11.2025 It has been pointed out that identical issue is involved in Cr.M.P. No.1895 of 2025. In view of that, Cr.M.P. No.1895 of 2025 is tagged with Cr.M.P. No.2257 of 2025. 3. These matters have been adjourned yesterday on the submission of the learned counsel for the petitioners. Today when the matters were taken up, learned counsel appearing for the petitioners seeks permission to withdraw these petitions on instruction. 4. Mr. Gadodia, learned counsel appearing for the ACB opposed the withdrawal of the petitions and submits that multiple proceedings have been initiated by these petitioners and if the affidavit brought on record by ACB will not be decided, it will prejudice the case of ACB. He also submits that in the anticipatory bail application filed by the petitioners, the said affidavit is also there. 5. In view of the above and considering the affidavit on the basis of which objection of withdrawal is being made is also there in the anticipatory bail application, in view of that, the objection of ACB can be decided in the anticipatory bail application after providing opportunity to the petitioners and the learned counsel for the petitioners have got no objection on that point. 6. In view of above submissions of the learned counsel for the parties, these petitions are dismissed as withdrawn. 7. It is made clear that the objection raised by the ACB is kept open to be decided in the anticipatory bail application, which is still pending. (Sanjay Kumar Dwivedi, J.) 07.11.2025 R.Kumar
