These criminal miscellaneous petitions have been filed at the instance of the petitioners with the self-same common prayer for restoration of Cr.M.P. No. 2488 of 2017 to its original file. Since both these criminal miscellaneous petitions have been filed with the self-same common prayer, hence these criminal miscellaneous petitions are disposed of by this common order. Learned counsel for the petitioners submits that Cr.M.P. No. 2488 of 2017 was dismissed for non-prosecution. It is next submitted that due to inadvertence, the then lawyer of the petitioners could not mark the case, hence when the case was called out, no one could appear before the Court resulting in dismissal of the said Cr.M.P. No. 2488 of 2017. It is next submitted that the petitioners have very good grounds to agitate in this Cr.M.P. No. 2488 of 2017 and unless Cr.M.P. No. 2488 of 2017 is restored to its original file, the petitioners will be highly prejudiced. Hence, it is submitted that the Cr.M.P. No. 2488 of 2017 be restored to its original file. Considering the aforesaid submission of the learned counsel for the petitioners, Cr.M.P. No. 2488 of 2017 is restored to its original file to the stage at which, it was before its dismissal.
