[2025:RJ-JP:42438] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 12398/2025 Neeraj Kumar S/o Sharwan Lal, Aged About 24 Years, R/o Gram Jhankdi, Tehsil And Police Station Thanagazi District Alwar (Raj.) (At Present Confined In Central Jail Alwar) ----Accused-Petitioner Versus The State Of Rajasthan, Through P.P. ----Respondent For Petitioner(s) : Mr. Dharmendra Choudhary for Mr. Sikandar Singh Sakkarwal For Respondent(s) : Mr. Manvendra Singh Shekhawat, PP HON'BLE MR. JUSTICE MAHENDAR KUMAR GOYAL
Order 16/10/2025 The present bail application has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity “the BNSS”). The accused-petitioner (for brevity “the petitioner”) has been arrested in connection with FIR No.0166 dated 06.05.2025 registered at Police Station Thanagazi, District-Alwar for the offence under Sections 189(2), 115(2), 126(2) and 303(2) of the Bharatiya Nyaya Sanhita, 2023 (for brevity “the BNS”) and later on for the offence under Sections 115(2), 126(2), 110 and 117(2) of the BNS.
Learned counsel for the petitioner submits that he has falsely been implicated in this case. He further submits that only grievous injury on the person of complainant-Naveen is a fracture of his nasal bone which, although, has not specifically been attributed to him; even otherwise, would not take the case beyond the scope of
[2025:RJ-JP:42438] (2 of 2) [CRLMB-12398/2025] Section 117(2) of the BNS which is bailable. Learned counsel submits that Section 110 has been added only to make the offence non-bailable. He also submits that the petitioner is in custody since 03.09.2025, investigation against him is complete, he has no criminal antecedents of similar nature and prays for release on bail. Learned Public Prosecutor opposed the prayer. Taking into consideration the contentions advanced by
learned counsel for the petitioner, nature of accusation, injury report of injured Naveen, his length of custody, absence of criminal antecedents of similar nature; but, without expressing any opinion on the merits of the case, this Court deems it just and proper to enlarge the petitioner on bail. Accordingly, the bail application is allowed and it is directed that accused-petitioner Neeraj Kumar S/o Sharwan Lal shall be released on bail under Section 483 BNSS in connection with afore- mentioned FIR registered at concerned Police Station, provided he furnishes a personal bond in the sum of ₹1,00,000/- (Rupees One Lac only) together with two sureties in the sum of ₹50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial court with the stipulation that he shall comply with all the conditions laid down under Section 480(3) BNSS.
