Chakravarthy Advocate for respondents : Learned G.P. for Forests CORAM : THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE RAVI CHEEMALAPATI DATE : 20th January 2025 P C : The present Writ Appeal has been preferred against the order dated 07.01.2025 passed in I.A.No.1 of 2025 in W.P.No.189 of 2025 whereby, the learned single Judge has declined the interim relief prayed for by the appellant, who was the petitioner before the learned single Judge. 2. The order which had been impugned by the appellant/writ petitioner before the learned single Judge was the order dated 12.12.2024, whereby, the entire tender process initiated by the official respondents had been cancelled firstly on the ground that most of the bidders had failed to meet the condition with regard to the breakup provided in Condition No.71 of the tender conditions, which was given in accordance with the directions contained in 2 Ministry of Finance Department of Expenditure, PP Division Office Memorandum No.29(1)/2014 – PPD, dated 28.01.2014 and which was also the requirement as per the tender document condition Nos.12, 14 and 77. 3. The case of the petitioner is that even though most of the other bidders had not complied with the tender conditions, yet since the petitioner did comply with those conditions, the tender process ought not to have been abandoned with a view to call for a re-tender and that the same was done for mala fide reasons. 4. Learned single Judge, however, by virtue of the order impugned, refused the interim relief to the petitioner on the ground that by re-tender, the petitioner would be entitled to participate in the said tender process and did not find it a fit case for grant of any interim relief. 5. Learned counsel for the parties agree that the process of re-tendering has not yet been initiated. We are also informed that the next date which has been fixed by the learned single Judge in the matter is on 23.01.2025 for completion of pleadings. 6. In our view, since the matter is being considered by the learned single Judge and the pleadings are not yet complete, any opinion expressed by this Court at this stage would affect the final outcome of the proceedings before the learned single Judge, we deem it proper that the matter be considered by 3 the learned single Judge in its entirety. We do not wish to interfere with the order passed by the learned single Judge at this stage. 7. Accordingly, the Writ Appeal is disposed of. No order as to costs.
