The interlocutory application I.A.No.1 of 2024 is filed under Order XXIII, Rule 3 read with Section 151 of CPC seeking to record the settlement under Memorandum of Understanding dated 09-01-2024 arrived at between the parties and dispose of the second appeal accordingly.
2. When the matter is taken up today, both parties are present along with their respective counsel and produced copies of Aadhaar Cards and both the parties have been identified by their respective counsel. Both parties represented that they have compromised the matter and Memorandum of Understanding entered into between them is enclosed in I.A.No.1 of 2024 and requested to dispose of the second appeal by recording the terms in the said Memorandum of Understanding.
3. Therefore, the interlocutory application is allowed and the terms of compromise are recorded. Accordingly, the second appeal is disposed of by recording terms of compromise entered into between both the parties. Pending applications, if any, shall stand closed. Each party do bear their own costs in the second appeal.
