Heard Sri S.V.S.S.Siva Ram, learned counsel for the petitioner, Sri K.Srinivasa Rao, learned counsel representing Sri Srinivasa Rao Putluri, learned counsel for the 3rd respondent. 2. The writ petition was admitted on 30.04.2013. An interim order was granted in WPMP No.16791 of 2013 which reads as under:
“In the light of the interim order granted in WP No.18779 of 2012, there shall be a direction to respondents 2 and 3 not to collect cross subsidy surcharge from the petitioner to the extent of the power sold by it to the APEPDCL and to the extent consumed by it for its own purposes.”

Today, when the matter is taken up for hearing, both the learned counsel submit that the issue involved in this writ petition is squarely covered by the order dated 20.06.2016 in W.P.Nos.18779 of 2012 and batch passed by the learned single Judge of the composite High Court. 5. Since the issue involved in the present writ petition is squarely covered by the order dated 20.06.2016 in W.P.Nos.18779 of 2012 and batch, the

orders dated 26.10.2012 impugned passed by the 1st respondent in O.P.No.73 to 77 of 2012 are set aside and OPs are remitted to the Regulatory Commission, for consideration afresh. 6. When the court posed a question regarding the stage of the matter earlier remitted, both counsel pleaded ignorance. The learned Andhra Pradesh Electricity Regulatory Commission, Visakhapatnam, is directed to dispose of the aforementioned OPs as per law, expeditiously. 7. Accordingly, the Writ Petition is allowed.
