The petitioner has been made accused in connection with Sarath P.S. Case No. 40 of 2023, S.T. Case No.386 of 2023, for the offence under Sections 148, 149, 341, 506, 326, 307 and 302/34 of the Indian Penal Code and subsequently, charge has been framed under Sections 147, 148, 324, 341, 326, 307, 506 & 302/34 of the Indian Penal Code, pending in the court of learned Additional Sessions Judge-I, Madhupur (Deoghar). Bail application of the petitioner was earlier rejected by this Court vide B.A. No.376/2025, by order dated 17.03.2025. On 03.04.2023, the Informant Noorsaba Bibi was returning home with her husband Basir Shah and nephew Sona Babu. On the way, they were intercepted by the petitioner and co-accused persons. There is specific allegation against the petitioner Gudu Shah @ Guddu Shah @ Md. Ali Shah that he had inflicted knife blow on the stomach and other parts of the body of the husband of the Informant, due to which, he succumbed to his injuries. Report regarding the stage of the trial, earlier called for, has been received. It appears that out of 14 charge-sheeted witnesses, 13 witnesses have already been examined. Considering the nature of allegation and the fact that the trial is at the fag end of its conclusion, I am not inclined to release the petitioner, on bail. Accordingly, the prayer for bail of the petitioner is hereby rejected. Learned Trial Court shall expedite the trial at the earliest. (Ambuj Nath, J.) November 07, 2025 BS/-
