1. The challenge in the present writ petition is to the impugned suspension order dated 21.07.2025 (Annexure-P/1) by which services of the petitioner has been placed under suspension and after placing the petitioner’s services on suspension, his head quarter has fixed in Bilaspur at the Office of Executive Director (B.A.), Chhattisgarh State Power Distribution Company Limited, Bilaspur.

Learned counsel for the petitioner would submit that the petitioner has been suspended for the charges levelled that while posting of the petitioner at Pakhanjur, certain irregularities have been committed by him, which was of the year 2018 and raising his grievances he already made an appeal in the form of representation on 22.07.2025 to the Respondent No. 1 & 2 which is pending for its consideration and the authorities may be directed to take a decision on the pending appeal of the petitioner in accordance with law within the stipulated time frame.

On the other hand, learned counsel for the respective respondents would submit that they have no objection if such a direction is being given to the Respondent No. 2 to take the decision on the pending appeal / representation of the petitioner dated 22.07.2025 within the stipulated time frame in accordance with law.

Considering the fact that the impugned order of suspension dated 21.07.2025 is an appealable order under the provisions of the Chhattisgarh Civil Services (Classification, Control and Appeal) Rules, 1966 (in short, The Rules, 1966), it would not be appropriate at this juncture to entertain the writ petition when the petitioner has right to
3 prefer an appeal and he has already avail his remedy by filing the appeal on 22.07.2025.
5. Reserving the right of the petitioner to prefer duly constituted appeal before the Respondent No. 2, the writ petition at this juncture can be
disposed of directing the petitioner to prefer an appeal within a period of 15 days from today. Accordingly, subject to petitioner’s preferring an appeal, the appellate authority i.e. Respondent No. 2 in turn is expected to take a decision on the appeal of the petitioner in accordance with rules, regulations and also appreciating the contents of the appeal at the earliest preferably within a period of 45 days from the date of receipt of appeal.
6. The appellate authority would also look into the grievance of the petitioner so far as changing of head quarter during the period of pendency of the appeal.
