JUDGMENT AND ORDER (ORAL)
1. Heard Mr. I. Kharmujai, learned counsel for the appellant (sic applicant).
2. Also heard Mr. N.M. Mansuri, learned counsel for the respondent No. 1.
3. As far as respondent No. 2 is concerned, the learned counsel for the applicant has submitted that affidavit of service has been filed before this Court, indicating that the notice issued upon the said respondent was duly affected. However, till date, the respondent No. 2 has failed to appear before this Court, as such, he prays that this matter may proceed ex-parte against the respondent No. 2. Prayer is allowed.
4. The learned counsel for the applicant has also submitted that the applicant, in the process of preferring the related appeal, a delay of 5 days has occurred, the ground being that copy of the certified copy of the impugned
judgment and award was not received on time by the applicant. Hence, the delay. It is prayed that the delay may be condoned and the appeal may be admitted. 2025:MLHC:259

5. Mr. N.M. Mansuri, learned counsel for the respondent No. 1 has no objection to the prayer made.
6. This Court, on consideration of the submission made, and the grounds cited for the delay in filing the related appeal, is convinced that it constitute sufficient cause. Accordingly, the delay of 5 days in filing the appeal is hereby condoned.
7. Misc. Case stands disposed of.
8. Registry is directed to diarize the appeal and list it for admission after 1(one) week. Judge
