Following relief has been claimed by the petitioner:- 10.1 That, this Hon'ble Court be pleased to call for the entire records pertaining to the case of the petitioner from the office of the Respondents by issuing a writ of certiorari and perusal of record would be pleased to command the respondents by directing them to pay 100% salary ASHISH TIWARI Digitally signed by ASHISH TIWARI Date: 2026.02.17 10:57:45 +0530 2 with the benefit of F.R. 22-D by protecting his basic pay of the previous post from the date of joining in the new post and further be pleased to direct the finance department to fix the petitioner's initial pay in the timed scale of the higher post as per F.R. 22-D by issuing a writ of mandamus. 10.2 That, after pay fixation it be ordered that all due annual increments be paid to the petitioner with interest and the difference amount may kindly be paid to him from the date of joining till the date of payment with interest as it is settled law that interest as a routine matter is provided to the concerned employee in case of delayed payment. 10.3 The Hon'ble court be pleased to grant any other writ order or directions in the circumstances of the case in favor of the petitioner. 2. Learned counsel for the parties submits that identical issue has arisen before this Court in case of Amrit Lal Sahu & Ors. Vs. Chhattisgarh & Ors. and connected matters in WPS No. 6436/2021. The Coordinate Bench, vide its judgment dated 19.11.2025 allowed the writ petitions of those petitioners with identical prayers, thus, this writ petition may be disposed of in terms of that order. 3. This preposition is not opposed by the learned counsel for the State. 4. Heard learned counsel for the parties and perused the records appended with the documents. 5. Coordinate Bench of this Court in case of Amrit Lal Sahu (Supra) after discussing in detail relying upon the various judgment of the Hon’ble Supreme Court allowed the writ petition and held as under in paragraph 56 :- 3 “56. The petitioners are, therefore, held entitled to full basic pay from the dates of their respective appointments, along with all consequential benefits flowing therefrom, including arrears, pay protection and continuity of service. The respondents are directed to re-fix the pay of the petitioners, compute and disburse the arrears, and carry out necessary corrections in the service records so as to reflect the protected pay and uninterrupted continuity of service.” 6. As the issue involved in this writ petition cannot be distinguished from the issue involved in the Amrit lal (supra), this writ is also disposed of in terms of that order. 7.
