1. The petitioner has been filed this writ petition on the following relief(s) :
“10.1 That, this Hon'ble Court may kindly be pleased to call the entire records from the respondents. 10.2 That, this Hon'ble Court may kindly issue an appropriate writ in the quash the impugned order Annexure P/1 dated 03/07/2025. 10.3 That, Hon'ble Court may kindly take action against respondent No.3 & 4 for not taking serious action on the caste certificate. 10.4 That, this Hon'ble Court may kindly issue a writ in the nature of Mandamus directing the respondent authority to issue Permanent Social Status Certificate to the Petitioner.”

Counsel for the petitioner contended that the petitioner belongs to Schedule Caste "Mahar" petitioner wants to get the benefit of caste in the Chhattisgarh, the petitioner preferred for “Permanent Social Status Certificate” online application No. 0704012412008506 before competent caste certificate issuing authority S.D.O. (Revenue) Rajnandgaon Tahsil & District Rajnandgaon, Chhattisgarh on 08/11/2024. The petitioner has also filed the relevant document application, affidavit with Inability Memo. Thereafter rejected the caste certificate application on 12/12/2024 by stating that the document of the petitioner's father is from Madhya Pradesh. Petitioner thereafter filed an appeal dated 16/12/2024 under Section 5 of the Chhattisgarh Scheduled Castes, Scheduled Tribes and Other Backward Classes
3 / 4 (Regulation of Social Status Certification) Act, 2013. The appellate Authority dismissed the appeal on 24/03/2025, stating that the appeal was not maintainable. Thereafter, petitioner file a writ petition WPC No. 1878/2025 an pass the order dated 17/04/2025. Thereafter, Petitioner file a fresh online application No. certificate issuing 0704012512100470 before competent caste authority S.D.O. (Revenue) Rajnandgaon Tahsil & District Rajnandgaon, Chhattisgarh on 28/04/2025 for the Permanent Social Status Certificate. Thereafter, the caste certificate application dated 03/07/2025 was Dismissed stating that the ancestors of the petitioner were not residents of Rajnandgaon Division before 1950. And the parents of the petitioner are not serving in the Chhattisgarh Government. 3. Counsel for the State opposes the submission made by counsel for the petitioner and contended that the alternate remedy is available to the petitioner to file the appeal before the concerned Collector, therefore, this petition is not maintainable. 4. I have heard learned counsel for the parties and perused the record with utmost circumspection. 5.
Considering the facts and circumstances of the case and submission made by learned counsel for the parties. Further considering that petitioner has alternative remedy to file appeal before the concerned Collector, at this stage this petition is disposed of with direction to the
4 / 4 petitioner to file appeal before the concerned Collector within ‘15 day’ from the date of receipt of copy of this order and in-turn the Collector/ appellate authority shall consider and decide the appeal of the petitioner as expeditiously as possible in accordance with rules, regulations and law. 6. It is made clear that this Court has not expressed any opinion on the merits of the case and the authorities shall not be prejudiced by any observation made by this Court and shall decide the case of the petitioners on its own merits. 7.
