05/ 18.12.2025 Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner is apprehending his arrest in connection with Pakur (M) P.S. Case No. 240 of 2023, registered for the offence under Section 392 of the Indian Penal Code, pending in the court of learned Sub-Divisional Judicial Magistrate, Pakur.

Learned counsel appearing for the petitioner submits that one auto was apprehended on the basis of CCTV footage and the driver of the said vehicle was apprehended and he has stated that petitioner was also involved in the crime. She next submits that four gas cylinders have been seized from the house of the petitioner, however, the said cylinders were not the theft cylinders and that were taken by the petitioner for domestic use by the authorized agency of Indane. She further submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in the supplementary affidavit filed on behalf of the petitioner.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the name of the petitioner has come on the basis of confessional statement of apprehended co-accused.

Considering that four gas cylinders one can keep in the name of different family members in the house for domestic use and further the name of the petitioner has come on the basis of confessional statement and the petitioner is having no criminal antecedent and disclosure to that effect has been made in the supplementary affidavit filed on behalf of the petitioner, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, named above, is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner, named above, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty- five thousand), with two sureties of the like amount each, to the satisfaction of learned Sub-Divisional Judicial Magistrate, Pakur, in connection with Pakur (M) P.S. Case No. 240 of 2023, subject to conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
