Heard Mr. Pran Pranay, learned counsel for the appellant. None appears on behalf of the State.
This appeal is directed against the order dated 27.08.2025 passed by the learned Additional Sessions Judge-VI, Giridih in M.C.A. No. 1695 of 2025 arising out of Jamua P.S. Case No. 37 of 2025, whereby and whereunder the prayer for bail of the appellant has been rejected. It has been submitted by learned counsel for the appellant that the appellant and five others were apprehended from a semi-constructed house where an illegal gun factory was said to have been running. It has further been submitted that two of the co-accused have been granted bail by this Court in Cr. Appeal (DB) No.986 of 2025. Learned counsel further adds that the appellant is in custody since 23.02.2025. It has also been submitted that the appellant does not have any criminal antecedent. Regard being had to the fact that the case of the appellant is similarly situated to those co-accused persons who have been granted bail, as noted above, we while setting aside the order dated 27.08.2025 passed by the learned Additional Sessions Judge-VI, Giridih in M.C.A. No. 1695 of 2025 arising out of Jamua P.S. Case No. 37 of 2025, direct the appellant to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-VI, Giridih in connection with M.C.A. No. 1695 of 2025. This appeal stands allowed and disposed of.
