W.P.NO.37321 OF 2022 ORDER:-
Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the respondents. 2.
This writ petition was filed questioning the action of the 2nd respondent in proceeding to hear the Revision CCLA.Ref.No.Sett.I(2)/17/2018 (Old No.CCLA’s Reference No.P2/726/91), without deciding the Interlocutory Application (IA) filed by the petitioners to call for the Gazette Notification, if any, under Section 2(b) of the Andhra Pradesh (Andhra Area) Estates, Communal, Forest and Private Lands (Prohibition of Alienation) Act, 1947 (Act No.XIV of 1947). 3. The learned counsel for the petitioners submits that the 2nd respondent did not take up the Interlocutory application filed in the revision petition. Hence, the present writ petition. 4. On the other hand, the learned Assistant Government Pleader, relying upon the written instructions of the 2nd respondent dated 22.08.2025, submits that as per the orders in W.P.No.8053 of 2004 of the erstwhile Hon’ble High Court dated 22.12.2007, the present Revision Petition in Settl-I(2)/17/2018 was filed by Sri G.Dasaratha Ramaiah (died) as per the LR’s G.Sumathi and three (3) others, with a request to reopen the case in RP No.P2/726/1991, dated 13.02.2003. Further, the said revision petition was called for hearing from time to time, duly issuing notice to all the parties concerned, and finally it was heard on 18.11.2022. On that day, during the hearing of the case, Sri G.Venkateswara Rao/the 2nd petitioner herein/the 4th revision petitioner therein filed a Memo stating that the Interlocutory application filed in the said revision was not considered to produce the Gazette Notification under Section 2(b) of the Act No.XIV of 1947. Aggrieved by the same, they filed the said writ petition and as there was a stay granted by the Hon’ble High Court, the revision petition is deferred for further hearing as “Lie Over” vide order dated 18.11.2025 of the 2nd respondent. 4
