Applicant has filed this first bail application under Section 483 of B.N.S.S., 2023 for grant of regular bail as he is arrested in connection with Crime No. 269/2023 registered at Police Station – Jutmil, District Raigarh (C.G.) for offence punishable under Sections 201, 120B and 302 of IPC. 2. Case of prosecution, in brief, is that one dead body was found on 01.07.2023 at Amlibharna Highway road at about 5:00 pm – 5:30 pm. Dead body was identified to be of one Manish Pandey. Merg was reported to the concerned Police Station, based upon which, crime was registered against unknown person. During course of investigation, 2 applicant was made accused on the basis of memorandum statement of co-accused Sarita Patel and he was arrested on 03.07.2023. 3. Learned State counsel opposes the bail application and would submit that from the documents filed along with this bail application, it shows that memorandum and seizure witnesses have supported case of prosecution and location of applicant, deceased and co-accused was on same place i.e. near place of incident. 4. After arguing for some time, learned counsel for applicant submits that he may be permitted to withdraw this bail application at this stage. 5.
