The petitioner has moved the Court for the Patna High Court CWJC No.7085 of 2025(2) dt.09-09-2025 7/9 following reliefs: “To direct the Respondent authorities to implement the judgment and order dated 26.04.2024, passed in LPA No. 458/2021 (arising out of CWJC No. 1744/2020) by the Division Bench of this Hon'ble Court, in respect of the Petitioners of the present writ application. The Petitioners are similarly situated to the appellants/petitioners of LPA No. 458/2021 and therefore, are entitled to all consequential benefits, including the refund of any recovered amounts and the restoration of pay fixation, recognizing their entitlement to the 1st ACP in the scale of Rs. 4000-6000/-, which was previously granted by the Respondents. II. To declare that the Petitioners are covered by the judgment and order dated 26.04.2024, passed by the Division Bench of this Honorable Court in LPA No. 458/2021. Consequently, pursuant to Clause 4 C (1) of the Bihar Litigation Policy, 2011, issued under the State Government's resolution dated 31.03.2011, they are entitled to receive the same and similar benefits as those granted to the appellants/petitioners of LPA No. 458/2021. Any discrimination against the Petitionen would constitute a violation of the Bihar Litigation Policy. 2011 by the Respondent authorities.” 3. At the outset, learned counsel for the petitioners has relied upon the order dated 02.04.2025 passed in C.W.J.C. No.5078 of 2025 and has submitted that similar direction be passed in the present writ petition as the case of the petitioners is similar to the case of the petitioners of C.W.J.C. No.5078 of 2025. 4. From the record, it appears that the case of the Patna High Court CWJC No.7085 of 2025(2) dt.09-09-2025 8/9 petitioners is similar to the case of the petitioners of C.W.J.C. No.5078 of 2025 5. Following directions have been passed in C.W.J.C. No.5078 of 2025, which reads as follows: “4. With the consent of parties, this writ application is disposed of directing the Director General of Police, Bihar, Patna to dispose of all the representations filed by the petitioners in which the petitioners have relied upon the judgment and order of this Court dated 26.04.2024 in LPA No. 458 of 2021 arising out of CWJC No. 1744 of 2020 (Annexure-P/6) for grant of reliefs to them. If the Director General of Police Bihar, Patna finds that the reliefs being sought by the petitioners are actually squarely covered by the judgment of this Court then the reliefs sought by the petitioners should be granted to them within a reasonable time and if not, then the representations of the petitioners should be decided by passing a detailed and speaking order. The Director General of Police Bihar, Patna should dispose of all the representations of the petitioners within two months from the date of production of copy of this order.
