2. 3.RSUDHARANI The Court made the following order: The above contempt case is filed complaining of non-compliance of the
order dated 28.06.2023 in W.P.No.14895 of 2023. The petitioner filed the above writ petition to declare the action of the respondents in not considering the representation dated 26.12.2022, on 05.06.2023, made by the petitioner for grant of all service benefits i.e. treating \ the suspension period as on duty, consequential terminal benefits, including the increments and pension, etc., as illegal and arbitrary.

The said writ petition was disposed of on 28.06.2023. The operative 0 portion of the order reads as under;

“...directing the respondents to complete and conclude the disciplinary proceedings/enquiry expeditiously preferably within a period of three months from the date of said
order and take appropriate action as per the final result. If for any reason, the respondents are unable to conclude the disciplinary proceedings within three (03) months, the respondents shall pay and release all retirement benefits and pension to the petitioner forthwith.” In the affidavit filed in support of the contempt case, it was pleadeif that the order dated 28.06.2023 has not been implemented.
4. When the matter is taken up for hearing, Smt. P. Saraswathi, learned counsel representing Sri G.V.S. Kishore Kumar,
learned counsel for the respondents, submitted instructions of the Director, Treasuries and Accounts Department, A.P., Mangalagiri. As seen from the instructions, the petitioner was paid GIS of Rs.96,041/- on 12.09.2024, GPF of Rs.6,99,251/- on 04.05.2021, commutation (composite share) of Rs.19,35,552/- on 14.04.2025, Commutation (A.P share) of Rs.2,67,320/- on 14.04.2025, Gratuity of Rs.10,54,379/- and 1,45,621/- on 29.04.2025 and an amount of Rs.49,900/- and 1,69,896/- towards encashment of earned leave, on 29.04.2025.
5. The instructions further disclose that the regular normal pension as per the eligibility is also being paid to the petitioner.
6. Thus, as seen from the instructions, the retirement benefits have been paid to the petitioner on different dates.

Learned counsel for the petitioner would submit that some of the increments have not been paid, however, endorsed concerning the payment of retirement benefits. ✓ )
Given the above instructions, since the respondents t;omplied with the
order dated 28.06.2023, by paying the amount, though some delay occurred, in the considered opinion of this court, the respondents did not commit any contempt by not implementing the order dated 28.06.2023 in W.P.No.14895 of
2023.

10. Therefore, this contempt case is closed. No costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
