Neutral Citation No. - 2025:AHC:73100-DB Court No. - 39 Case :- WRIT - C No. - 13100 of 2025 Petitioner :- Pradeep Kumar Garg Respondent :- Union Of India And 2 Others Counsel for Petitioner :- Aishwarya Pratap Singh Counsel for Respondent :- A.S.G.I.,Anadi Krishna Narayana,Vivek Kumar Singh Hon'ble Arindam Sinha,J. Hon'ble Avnish Saxena,J. Mr. Aishwarya Pratap Singh, learned advocate appears on behalf of petitioner and submits, his client has been told there stands issued a lookout circular. He was prevented from boarding the aircraft on 24th July, 2022 to fly from Delhi to Kathmandu. In spite of best efforts, he has not been given copy of the lookout circular. To the best of his information, respondent no. 3 (Bank of Baroda) got issued the circular on allegation that his client had furnished personal guarantee in respect of a company. He submits, his client has resigned from the company and personal guarantee was substituted by the incoming Director. He seeks issuance of certiorari to call for the records and quash the lookout circular. Mr. Vivek Kumar Singh, learned advocate appears on behalf of respondent nos. 1 and 2 (Union of India and External Affairs Ministry). On query he submits, the writ petition does not disclose the lookout circular. Mr. Anadi Krishna Narayana, learned advocate appears on behalf of respondent no. 3 (Bank). It appears objection was earlier raised against petitioner on omission to disclose the lookout circular in the writ petition. Supplementary affidavit dated 23rd April, 2025 was filed by him
disclosing steps taken including applying under Right to Information Act, 2005 to obtain copy of the circular. Petitioner says, the lookout circular was never ever served or shown to him, not even when he was prevented from boarding the flight on 24th July, 2022. Considering there was objection raised by respondent no. 2, alleging omission on part of petitioner to disclose the circular, there is presumption that no such circular exists. Petitioner is entitled to this declaration. Petitioner will be further entitled to travel abroad and can only be stopped on production of the lookout circular and copy of it served on him. The writ petition is disposed of. Order Date :- 7.5.2025 NSC (Arindam Sinha, J.) (Avnish Saxena, J.) Digitally signed by :- NARENDRA SINGH CHAUDHARY High Court of Judicature at Allahabad
