2 140/2025 registered at Police Station – City Kotwali Raigarh District – Raigarh (C.G.), for the offence punishable under Sections 318(4) & 3(5) of the Bhartiya Nyaya Sanhita, 2023 & 66(d) of IT Act. 2. The prosecution case is that the complainant, namely Gourishankar Beriwal, who is engaged in trading, lodged a written complaint on 04.04.2025 stating that some unknown person had fraudulently withdrawn money from his savings account between 30.10.2024 and 16.11.2025, amounting to a total of Rs. 17,16,552/-. On the basis of the said complaint, an FIR was lodged at the concerned police station. 3. The applicants are innocent and have been falsely implicated in the present case, having no role in the alleged offence. The applicants are young boys, and their entire career would be ruined if they remain incarcerated. It is further submitted that the applicants are permanent residents of the address mentioned in the cause title of the bail application, and there is no likelihood of their absconding or tampering with the prosecution witnesses. The present applicants have been in jail since 22.05.2025, therefore he prays for regular bail to the applicants. 4. The learned counsel for the State/non-applicant as well as learned counsel for the objector opposed the bail application of the applicants and submits that applicants has two criminal antecedents, therefore they are not entitled for regular bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6.
Considering the facts and circumstances of the case, the nature and gravity of the offence, and the material available in the case diary, it
3 appears that the applicants/accused fraudulently obtained a sum of Rs. 17,16,552/- from the complainant’s bank account through net banking and thereby committed fraud. Therefore, I am not inclined to grant regular bail to the applicants in this case. 7. Accordingly, the bail application of the applicants - Mukesh Chaudhary & Suresh Chaudhary involved in Crime No. 140/2025 registered at Police Station – City Kotwali Raigarh District – Raigarh (C.G.), for the offence punishable under Sections 318(4) & 3(5) of the Bhartiya Nyaya Sanhita, 2023 & 66(d) of IT Act, is rejected.
