Complaint is lodged by one Parameshwarappa son of Nagendrappa alleging that some unknown persons have committed theft of 4 quintals of arecanuts valued at Rs.2,00,000/- from his land situated in Haronahalli, on the intervening night of 30-31.08.2024. 3. FIR is registered against unknown persons. It appears that after the arrest of accused No.1, his voluntary statement was recorded and on that basis petitioner is arraigned as an accused in this case. - 3 - NC: 2025:KHC:1948 CRL.P No. 14259 of 2024 4. Learned High Court Government Pleader has contended that the petitioner is involved in another case in Crime No.204/2024 registered under Section 86 and 87 of Karnataka Forest Act, 1963 and Section 379 of IPC. 5. In the present case there are no sufficient material at this stage to deny the relief sought by the petitioner. Petitioner has undertaken to cooperate with the investigation and furnish sufficient surety to ensure his regular presence before the trial Court. Hence, the following: ORDER Petition is allowed. Petitioner/accused No.2 in Crime No.95/2024 of Basavapatna Police Station, Davanagere, shall be released in the event of his arrest, subject to following conditions: a) He shall appear before the Investigating Officer within 10 days from the date of receipt of a copy of this order and shall - 4 - NC: 2025:KHC:1948 CRL.P No. 14259 of 2024 execute a personal bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with two sureties for the likesum and shall cooperate with the investigation. b) He shall furnish proof of his residential address and shall inform the I.O., if there is change in the address. c) He shall not tamper with the prosecution evidence/witnesses either directly or indirectly. e) He shall be regular in attending the Court proceedings.
