THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE MOHAMMAD NAWAZ ORAL ORDER Petitioner is seeking to enlarge him on anticipatory bail in Crime No.204/2024 of Santhebennur Police Station, Davanagere, registered for offences punishable under Section 86 and 87 of Karnataka Forest Act, 1963 and Section 303 (2) of BNS, 2023. 2. Heard both sides and perused the material on record. 3. Complaint is lodged by Raghvendra M S/o. M Satyanarayana with Santhebennur Police, on 22.10.2024 reporting theft of sandal wood tree grown in property bearing Sy.No.21/P belonging to one Lakshminarayan, Kashipura village, Channagiri Taluk, Davanagere. It is - 3 - NC: 2025:KHC:7689 CRL.P No. 14256 of 2024 alleged that some unknown persons have cut and removed the sandal wood tree worth Rs.25,000/-. 4. FIR was registered on 22.10.2024 against unknown persons. On the same day accused No.1 was arrested, who is alleged to have confessed that he along with other accused persons have cut and removed the sandal wood tree. 5. Learned High Court Government Pleader contended that there is one more case registered against the petitioner in Crime No.95/2024 at Basavakalyan Police Station, Davanagere. The learned counsel for the petitioner has contended that the petitioner is innocent and he has been implicated in false cases. 6. Petitioner is shown as accused No.2 in the remand application. At this stage accept the voluntary statement of accused No.1, there is no material against him. In Crime No.95/2024, he has been enlarged on bail by this Court in Criminal Petition No.14259/2024 dated 17.01.2025. He has undertaken to cooperate with the - 4 - NC: 2025:KHC:7689 CRL.P No. 14256 of 2024 investigation of the case, hence, the relief sought in the petition can be granted imposing conditions. Accordingly, the following: O R D E R Petition is allowed. Petitioner/accused in Crime No.204/2024 registered at Santhebennur Police Station, Davanagere, is ordered to be released in the event of his arrest, subject to following conditions: a) He shall appear before the Investigating Officer within one week from the date of receipt of a copy of this order and shall execute a bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for the likesum. b) He shall furnish his residential address/contact number and shall inform the I.O. in case of any change in the address/contact number. - 5 - NC: 2025:KHC:7689 CRL.P No. 14256 of 2024 c) He shall co-operate with the investigation of the case. d) He shall not tamper with the prosecution evidence/witnesses either directly or indirectly. e) He shall be regular in attending the Court proceedings.
